FULL TERMS AND CONDITIONS OF THE KENT SADDLERY 2024 CALENDAR PHOTO COMPETITION
1. Promoter:

2. Promotion Period:
2.1 The Promotion will commence at 8.00am on Friday, 18th August 2023 and will close at 11.59pm Australian Eastern Standard Time on Wednesday, 13th September 2023.
3. Eligibility:
3.1 The competition is open to any person.
4. Entry requirements:
4.1 Photos entered should be in a landscape format, and be symbolic of country life. All photos entered must have available a high quality copy of the image suitable for printing at approximately A4 size which must be made available to Kent Saddlery upon request.
4.2 Photos are to be submitted by posting via the form on the competition page.
4.3 Each entrant may submit up to 5 photos.
4.4 If known, information about where and when the photograph was taken, along with any extra information about the shot which may be useful and/or interesting is to be submitted with the entry.
4.5 As all photos entered will be displayed on Facebook and Instagram, each participant agrees to abide by Facebook’s Community Guidelines and associated platform guidelines.
4.6 It is a condition of entry that the entrant is the photographer, or has the photographer’s permission to enter the competition. By entering this competition, the entrant and the photographer agree to the terms and conditions of this competition. Where the entrant and the photographer are two different people, proof of authority by the photographer to enter the competition is required. Please contact Kent Saddlery about how to provide proof of authority from the photographer.
4.7 It is a condition of entry that any photos containing a recognisable image of a person, have that person’s permission to enter the competition, and that person’s permission to have their photo published in Kent Saddlery’s 2024 Calendar, and in other publications and media as outlined in the terms and conditions of this competition. Proof of authority by person/s recognisable in a photo entry for entry in the competition and use of the photo/s is required. Please contact Kent Saddlery about how to provide proof of authority from the person/s in a photo entry.
4.8 Where entries are being submitted by a person other than the original photographer, proof of consent of the original photographer for entry of the photograph must be provided where required by copyright law.
4.9 Only those photographs submitted during the Promotion Period will be considered.
4.10 Entrants may be asked to supplement their submission (by providing a paragraph about the photograph, consent in relation to the photograph, the highest resolution version of the photograph, or a watermark-free version of the photograph) any time after entering the competition, and before winner/s is/are decided.
4.11 Photographs may be altered to a level of standard optimisation (e.g. cropping, reasonable adjustments to exposure, colour and contrast) but should still retain a sense of the scene which was captured. Multiple exposures that have been combined to produce a single image are acceptable. Specialty cameras and filters are permitted, but the resulting images must be submitted electronically.
4.12 Submissions may be watermarked if desired, but the watermark should be inconspicuous enough so as not to interfere with the clarity of the photograph. Watermarked photographs may be deemed ineligible (at Kent Saddlery’s discretion) if the photographer is unable or unavailable to provide a pristine, watermark-free version of the image when requested.
4.13 By entering the competition entrants give their informed consent to allow Kent Saddlery to use their image for marketing material, including but not limited to, Kent Saddlery’s website, Facebook page, Instagram account, calendar, mail order catalogues and other printed and electronic publications such as flyers and brochures, in press releases, newsletters, e-newsletters, displays including Kent Saddlery’s in-store slideshow, newspaper advertising, reports and presentations, without any fee or other form of compensation and an irrevocable, perpetual, non-exclusive licence for Kent Saddlery to use, edit, reproduce and distribute their entered photograph. Kent Saddlery will credit all works in the above locations with the photographer’s name.
4.14 All material submitted for entry into the competition:
a. Must be intended for a general audience and therefore not contain, depict or refer to any crude, vulgar, obscene, pornographic, sexually explicit, disparaging, discriminatory, offensive, illegal or otherwise unsuitable activity or other content (as determined by Kent Saddlery at its sole discretion);
b. Must not be defamatory, racially offensive, invasive of privacy or in breach of confidence;
c. Must be original and not be contrary to, infringe or breach any law or any person’s right under any law (including but not limited to privacy, intellectual property rights, copyright, defamation, passing off or confidentiality);
d. Must only use original or royalty free material;
4.15 Any entry found to infringe the rights of any third party, including copyright, trademarks, privacy, publicity, confidentiality or proprietary rights will be disqualified and the entry removed.
4.16 This competition is being run by Kent Saddlery and is in no way sponsored, endorsed or administered by or associated with Facebook. Personal information provided in the course of entry in the competition is provided to Kent Saddlery and not Facebook.
4.17 Kent Saddlery’s decision in relation to any aspect of the competition is final and binding on every person who enters. No correspondence will be entered into.
5. Prizes:
5.1 Winners will have their photograph published in the 2024 Kent Saddlery Calendar which will be distributed all over Australia and also reaching other countries. All winners with a photo chosen and used in the 2024 Kent Saddlery Calendar will also receive 2 x complimentary 2024 Kent Saddlery Calendars and a Kent Saddlery Gift Voucher valued at $50.00.
5.2 The winning photos will be selected by the owners and/or employees of Kent Saddlery at their discretion. Images will be judged on appeal, impact and suitability to the purpose of the 2024 Kent Saddlery Calendar. The decision of the Judging Committee will be final and no correspondence will be entered into. The selection of winner/s is not binding on Kent Saddlery.
5.3 There may be no photos entered in the competition meeting the requirements of the Kent Saddlery 2024 Calendar, in which case there will be no winner in the competition.
5.4 The minimum number of winners in the competition is zero, and the maximum number of winners is thirteen.
5.5 The entrants of all photos chosen as suitable for the Kent Saddlery 2024 Calendar will be asked to provide a high quality copy of the photo, and if the photo proves to be of insufficient quality for the purpose of printing for the calendar, the photo will not be eligible for a win or a prize.
5.6 Prizes are not transferrable.
5.7 The winners will be notified by private message, telephone, email or mail by Friday, 6th October 2023 and will be provided with details regarding publication of the winning photo. The winners will be announced on the Kent Saddlery website, Kent Saddlery Instagram, and Kent Saddlery’s Facebook page (www.facebook.com/kentsaddlery) on or before Tuesday, 10th October 2023.
6. Release:
6.1 To the extent permissible by law, you release Kent Saddlery, Facebook, Instagram, their agencies and employees from any causes of action, loss, liability, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred by you (including any indirect or consequential loss) in connection with your participation in the competition.
6.2 This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram.
7. Force Majeure:
7.1 Kent Saddlery will not be responsible or liable for any loss, cost or damage arising out of the competition for any act, omission, failure or delay by Kent Saddlery or other party which is due to an act of god, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts which are not reasonably within the control of Kent Saddlery.
8. Rights to Entries:
8.1 Any entries become the property of Kent Saddlery. Any entries not completed in accordance with the terms and conditions or received after the closing time and date of the competition will not be considered.
9. Privacy Notice:
9.1 During the course of the Promotion, Kent Saddlery may collect personal information from entrants, including their name and contact details for the purposes of acknowledging the owner of the intellectual property rights in the published photographs; and contacting the prize winner. Photographs published on Kent Saddlery’s Facebook page and website will include the name of the photographer and/or entrant.
9.2 The Kent Saddlery Facebook page is a public application. By entering this competition the entrant has given authority for their entry to be included on Kent Saddlery’s Facebook page and/or website and/or Instagram, and in publications as mentioned at 4.13 above. The entrant’s name, photographer’s name, the name/s of person/s appearing in a submitted photo, photographs and photograph title submitted for entry into the competition will be publicly visible to anyone who visits Kent Saddlery’s Facebook page and/or website.
9.3 All personal information will be treated in accordance with Kent Saddlery’s Privacy Policy, a copy of which may be obtained by contacting Kent Saddlery.
9.4 In entering the competition all entrants agree to the lawful collection, use and disclosure of their personal information in accordance with Kent Saddlery’s Privacy Policy. Entrants are able to request access to the personal information Kent Saddlery holds about them by contacting Kent Saddlery.
9.5 Entry Photographs displayed on Kent Saddlery website and/or Facebook page and/or Instagram account will be subject to the Terms and Conditions of the website www.kentsaddlery.com.au which authorises users to download and/or print any photos or information from the Kent Saddlery website for personal use. The material in the Kent Saddlery website cannot be downloaded or reproduced for any other purpose without the prior permission of the author and copyright owner.
10. Program Interruption:
10.1 Kent Saddlery, at its sole discretion, reserves the right to cancel, suspend, terminate or modify the Promotion if fraud, technical failures or any other factor beyond Kent Saddlery’s reasonable control adversely affect Kent Saddlery’s ability to conduct the competition as described in these Terms and Conditions.
